Extending your work permit lets you keep working in Canada when the permit expires, or change certain conditions. The process depends on the type of permit (employer-specific or open) and on your situation.
When should you extend your work permit?
As soon as your permit is nearing its expiry and you want to keep working, or if you need to change conditions such as the employer, the location or the type of work. A change of employer is not a simple extension: it requires a separate authorization.
Apply before the permit expires
According to IRCC, the application should be submitted at least 30 calendar days before the permit expires. An application submitted before the expiry lets you keep your status. Planning ahead also leaves time to gather the documents, especially those from the employer. Form IMM 5710 is the form for applying to extend or change the conditions of a work permit.
Maintained status after an application submitted in time
If your application is submitted before your permit expires, you may, according to IRCC:
- keep working without a permit until a decision is made, under the same conditions as your current permit;
- stay in Canada while the application is assessed;
- for an employer-specific permit: keep working for the employer named on the permit, doing the same type of work in the same location.
Maintained status is not a new permit and does not apply in every situation. See our page on maintained status.
What if the permit has already expired?
If no application was submitted before the expiry, the situation is different: the status has to be restored through a separate process, within a specific period. Restoring status and the right to work are two separate questions. See our page on restoration of status.
Special situations
- LMIA: if the position requires a Labour Market Impact Assessment, the employer's process generally has to be completed before your application (exceptions exist);
- CAQ in Québec: the employer generally submits the temporary selection application, with some exceptions: see LMIA and CAQ;
- Duration: a permit cannot be extended beyond the validity of your passport.
