If your temporary status (student, worker or visitor) has expired, a restoration application should generally be filed within 90 days of the expiry date. A well-prepared file avoids incomplete-application returns, which cost valuable time. Here is what to gather.
Conditions to check first
Before collecting documents, make sure you can show, based on the criteria published by IRCC:
- that you are applying within the 90-day period;
- that you complied with the conditions of your previous status (for example, you did not work without authorization);
- that you still meet the requirements of the category you are applying under (study, work or visitor stay);
- that your situation is explained clearly and honestly.
Core documents
- Valid passport (identity pages, visas and stamps);
- Previous permit or immigration document, showing its expiry date;
- The form for the relevant category, completed and signed;
- Proof of payment of the fees, which include the restoration fee and the fee for the new permit requested;
- Compliant photos, if required for your category.
Documents specific to each situation
- Student: proof of enrolment, letter of acceptance or school confirmation, transcripts, proof of sufficient funds and, in Québec, a valid CAQ if required;
- Worker: job offer or contract, employer letters, pay stubs and, where applicable, proof of the employer’s authorization;
- Visitor: proof of funds, purpose of stay, ties to your home country and a return plan.
The letter of explanation
This is often the most decisive document. It should say why the status expired, what has happened since, and what you intend to do. It must be consistent with the rest of the file: a contradiction between the letter and the supporting documents is a common cause of refusal.
Mistakes to avoid
- Waiting until the end of the 90-day period to start preparing;
- Submitting illegible or expired documents, or documents without a certified translation where needed;
- Forgetting to pay the new permit fee on top of the restoration fee;
- Continuing an unauthorized activity while waiting.
