International Mobility Solutions: Hiring without LMIA

LMIA Exemptions & Mobility: Strategic Solutions

The LMIA Exemption stream provides essential flexibility for Canadian businesses. Unlike the traditional TFWP, these programs allow for the integration of strategic talent without a Labour Market Impact Assessment.

This approach, grouped under the International Mobility Program (IMP), significantly reduces processing times and administrative burdens.

What is an LMIA Exemption?

An exemption allows an employer to bypass the requirement to prove that no local candidates are available for the position. These exceptions, governed by IRCC, generally fall into two major categories:

  1. Significant Benefit: Hires that generate major economic, cultural, or social benefits for Canada (e.g., Francophone Mobility, Intra-company Transfers).
  2. Reciprocal Agreements: Mobility facilitated by international treaties or exchange programs (e.g., International Experience Canada).

The Simplified Employer Journey (3 Steps):

To benefit from an exemption, the company must follow a rigorous protocol through the Employer Portal:

1. Targeting: Identifying the specific exemption code (e.g., C10, C16, T23).

2. Validation: Paying the $230 employer compliance fee.

3. Linking: Providing the official offer of employment number to the candidate before they submit their Work Permit application.
