Status restoration (also called "restoration of status") is a process that allows temporary residents in Canada who have fallen out of status to legally restore their authorization to remain in the country. It applies to individuals who held a valid study permit, work permit, or visitor record that has since expired.
Under Canadian immigration law, if your temporary resident status expires while you are still in Canada, you have a grace period of 90 days to submit a restoration application to Immigration, Refugees and Citizenship Canada (IRCC). You must apply before that 90-day window closes — once it passes, restoration is no longer an option and you may be required to leave Canada and apply from abroad.
While your restoration application is pending, you are considered to be in a maintained status ("implied status" does not apply here — restoration is a separate mechanism). You must continue to comply with all the conditions of your original permit during this period and must not engage in any activity — such as working or studying — that your expired permit authorized unless you hold another valid authorization.
If your situation involves a work permit, study permit, or visitor record, restoration may allow you to renew your legal presence in Canada without the disruption and cost of leaving and re-entering. This is an invaluable option for international students, workers, and visitors who missed their renewal deadline.
To be eligible for status restoration, all of the following conditions must be met. A single unmet condition can result in a refusal — this is why professional guidance is critical.
The application must be submitted to IRCC within 90 calendar days of the expiry of your study permit, work permit, or visitor record. This deadline is strict — there is no extension possible once it passes.
You must not have worked or studied in Canada after your status expired, unless you held a separate valid authorization. Any violation of this condition will make you ineligible for restoration.
You must demonstrate that you respected all conditions of your original permit while it was valid — including maintaining enrollment (for study permits) or working for the authorized employer (for work permits).
Status restoration is only available to applicants who are physically in Canada at the time of application. If you have already departed Canada, you must apply for a new permit from outside the country.
You must still meet all the requirements of the permit category you are restoring — for example, remaining enrolled at a designated learning institution for a study permit, or maintaining a valid job offer for a work permit.
You must hold a valid passport that covers the requested period of restoration. If your passport has expired, it must be renewed before submitting your restoration application.
