What Is Status Restoration?

Status restoration allows a temporary resident whose permit has expired to regain legal status in Canada β€” without having to leave the country β€” if certain conditions are met and the application is submitted within 90 days of the expiry date.

During the restoration period (between expiry and IRCC's decision), you benefit from implied status β€” but only if you applied on time and continue to respect the conditions of your former permit.

Missing the 90-Day Deadline
The most common and most fatal mistake. Many people mistakenly believe they have more time, confusing "implied status" (renewal in progress) with "restoration." Once 90 days pass after expiry without an application, restoration is impossible. IRCC is inflexible on this point β€” no extension is granted under any circumstances.

Working or Studying Without Authorization
During the restoration period, you may ONLY do what your expired permit authorized β€” and only if you applied for restoration within the 90 days. Working or studying without being authorized to do so constitutes a violation that makes your restoration application inadmissible and can lead to a removal order.

Leaving Canada During the Restoration Process
If you leave Canada while your restoration application is pending, IRCC will consider the application automatically abandoned. You will then need to apply for a new permit from outside the country β€” losing all progress and facing a potential 6 to 12 month wait.

A restoration application returned due to missing documents does NOT stop the 90-day clock. You will receive the Return of Application (ROA) weeks or months later β€” and your 90 days may have long passed by then. Every document must be included and correct from the first submission.

Conversely, many residents don't know that submitting a renewal application before their permit expires protects them with implied status. You can work or study legally while waiting for IRCC's decision β€” even if your physical permit has expired. This is the ideal scenario to avoid needing restoration.
