What Is Status Restoration?
Status restoration allows a temporary resident whose permit has expired to regain legal status in Canada β without having to leave the country β if certain conditions are met and the application is submitted within 90 days of the expiry date.
During the restoration period (between expiry and IRCC's decision), you benefit from implied status β but only if you applied on time and continue to respect the conditions of your former permit.

If the 90-day window has passed without a restoration application, your options are limited: voluntary departure, PRRA (Pre-Removal Risk Assessment) if applicable, or humanitarian and compassionate grounds application (H&C). Each of these is complex, costly, and uncertain. The golden rule: never let a permit expire without a plan β contact us before the deadline, not after.

- Form IMM 5708 β Application to Restore Temporary Resident Status
- Applicable fees: $229 CAD (restoration) + fees for the new permit requested
- Copy of expired permit and all previous Canadian immigration documents
- Explanation letter: justified reasons for the delay in renewal
- Supporting documents depending on the type of permit requested (study letter, job offer, etc.)
- Proof of compliance during the unauthorized period
Best prevention: Apply for renewal of your study or work permit at least 90 days before expiry. This guarantees implied status even in the event of processing delays, and completely eliminates the need for restoration. Mark the date in your calendar β 90 days before your permit expires.
